Bankruptcy While Abroad

If you live abroad outside the EU you can petition for bankruptcy in the UK if :-

1. You are present in England and Wales on the day you present your bankruptcy petition.

OR

2. You have lived or carried on business in England and Wales in the last three years.

OR

If you are living in an EU member state ( excluding Denmark) you need to be able to demonstrate that while you live abroad your centre of main interest is in the UK.

If you have been outside the UK for over 3 years or are unable to satisfy the court that your centre of main interest then you will not be able to pursue insolvency in the UK. If this is your situation then you may need advice about a Debt Management Plan or the Reviva Plan.
