Bankruptcy While Abroad

If you live abroad outside the EU you can petition for bankruptcy in the UK if :-

1. You are present in England and Wales on the day you present your bankruptcy petition.

OR

2. You have lived or carried on business in England and Wales in the last three years.

OR

If you are living in an EU member state ( excluding Denmark) you need to be able to demonstrate that while you live abroad your centre of main interest is in the UK.

If you have been outside the UK for over 3 years or are unable to satisfy the court that your centre of main interest then you will not be able to pursue insolvency in the UK. If this is your situation then you may need advice about a Debt Management Plan or the Reviva Plan.

IVA while abroad

The eligibility of an IVA while abroad is similar to bankruptcy while abroad. The 3 year rule is critical.

Debt Management Plans and The Reviva Plan, are both accessible solutions while abroad. However care should be taken when commencing a solution due to the cost of trasfering funds and exchange rate issues. We would recommend transferring sufficient money to the UK on a quarterly basis to reduce the transfer costs and to build in an exchange rate contingency.
